Terms & Conditions – Instant POA

1. Introduction

These Terms & Conditions (“Terms”) govern your use of the website instantpoa.ae (“Website”) and any services provided through it by Instant POA Businessman Services L.L.C. By using the Website, you acknowledge that you have read, understood, and agreed to be bound by these Terms.

2. Scope of Services

Instant POA offers administrative and documentation services across the following categories:

a. Power of Attorney (POA) services:

• Family POAs: child travel consent, no-objection for minors, inheritance POA, marriage-related POA.
• Real estate POAs: sell-property POA, buy-property POA, property-management POA.
• Corporate POAs: company-formation POA, company-management POA, shares/equity POA.
• Vehicle POAs: sell-vehicle POA, export-vehicle POA, general vehicle POA.
• General/special POAs for other purposes upon client request.

b. Attestation services:

• Ministry of Foreign Affairs (MoFA) attestation.
• Certified True Copy services.
• Coordination of embassy attestation where required.

c. Certified legal translation:

• Between Arabic and multiple languages (English, Russian, German, French, Italian, Spanish, Chinese), with attestation as an optional add-on.

d. Additional services:

• Document preparation, follow-up on verification/attestation procedures, and coordination with government authorities or embassies as needed.

Unless expressly stated otherwise, services are administrative in nature and do not constitute individual legal advice.

3. User Responsibilities

By using the Website, you agree to:

• Provide accurate, complete, and up-to-date information and documents when submitting any form or request, including via WhatsApp.
• Not misuse the Website, including attempting to hack, disrupt, or overload its systems.
• Comply with all applicable laws and regulations in the United Arab Emirates.
• Not use the services for any unlawful, fraudulent, or prohibited purpose.

4. Fees and Payments

• The cost of a service consists of two separate components: (1) Instant POA's service fee for preparation, coordination, and follow-up, and (2) official/government fees (e.g. Notary Public, MoFA, embassy, or certified translation fees) which are set by the relevant authority and are not owed to Instant POA.
• Our service fee is displayed separately and clearly from government fees in the quotation or invoice sent to the client before order confirmation.
• Certain services require full or partial advance payment (service fee and/or estimated government fees) before processing begins.
• An order is considered confirmed only after payment is received in full through approved payment methods.
• Any additional charges later imposed by government authorities, embassies, or delivery providers are communicated to the client as soon as they are known and are not considered part of the original service fee.

5. Cancellation and Refunds

• You may request to cancel a service before work has actually commenced (i.e. before document preparation begins or an official appointment is booked) without incurring fees, except for any non-refundable government fees already paid to a third party.
• Once document preparation, processing, or an official appointment booked on the client's behalf has started, the service fee paid is generally non-refundable, unless otherwise agreed in writing.
• If a service cannot be completed due to a material error attributable to Instant POA, the service fee paid will be refunded in full; any government fees already paid remain subject to the refund policy of the relevant official authority.
• Cancellation or refund requests must be submitted in writing via email or the official WhatsApp number, and will be reviewed and responded to within a reasonable timeframe.
• Delays caused by government authorities or embassies (outside Instant POA's control) do not constitute grounds for a refund; the client will be kept informed of any developments.

6. Limitation of Liability

Instant POA shall not be liable for:

• Delays or decisions made by government authorities, embassies, or other official bodies.
• Rejection of applications or documents due to rules, policies, or internal criteria of such authorities.
• Any misuse or alteration of documents after they have been delivered to the user.
• Any indirect, incidental, or consequential loss, including loss of profit or opportunity.

While we strive for the highest standards of accuracy and diligence, acceptance and final approval of documents or transactions is always at the discretion of the relevant official authority.

7. Handling of Sensitive Documents and Data

• Sensitive personal documents and data (ID copies, passports, contracts, official documents) submitted via online forms or WhatsApp are handled in strict confidence and in accordance with our Privacy Policy.
• Clients who have concerns about sending sensitive documents through a given channel are advised to contact us so we can offer an alternative secure channel.
• We retain copies of documents only for as long as necessary to complete the service and comply with legal obligations, after which they are securely deleted or archived in accordance with our Privacy Policy.

8. Intellectual Property

All content available on the Website, including text, graphics, logos, icons, and layout, is the exclusive property of Instant POA or used under valid license, and is protected by applicable intellectual property laws. No content may be copied, reproduced, or redistributed without prior written consent.

9. Changes to the Terms

We may update these Terms from time to time to reflect the evolution of our scope of services or operational procedures. The revised version will be posted on this page with an updated “Last updated” date reflecting the actual date of the amendment. Your continued use of the Website after such changes constitutes your acceptance of the updated Terms.

10. Governing Law and Jurisdiction

These Terms are governed by the laws of the United Arab Emirates. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive or non-exclusive jurisdiction (as applicable) of the courts of the Emirate of Dubai or Abu Dhabi, depending on the place of service performance or registered business address.
